Many non-Spanish people would like to build their own Spanish casa, conforming to the standards and norms of their own countries. However, there are many areas where the building process is different to those in other countries, and things can quickly become an administrative mess if you’re not careful.
Let’s highlight a few points about the building process in Spain.
After finding a good building plot you have to check the status of the land itself, for example to find out if it is located in an urbanised area and also connected to the essential infrastructures needed for habitable dwellings, or in a rustic zone (e.g. agricultural land) where you are not usually allowed to build properties for residential or commercial purposes. Exceptions to restrictions may apply – for example, you may be allowed to build on between 2 and 4% of the surface area.
Next, you enter the permit process. You have to deal with local building regulations, often commission a topographical survey, ascertain your rights and those of your neighbours, and to check if the property is legal. Next on your list is to engage a technical architect who will draw up your plans and present them to the municipality for approval.
We strongly recommend that our clients work out a draft design with us before spending expensive hours going through the project with an architect. We are often much more practical in our approach, in which the word ‘impossible’ just does not appear.
Once the architect has been engaged, the first step is to draw up a basic design (Proyecto Básico) based on your wishes. After this the architect will draw up the final design (Proyecto Ejecución) which is submitted to the municipality. After municipality approval of the design, you will receive the final permit (La Licencia de Obras). You will have to pay a municipal tax (Impuesto sobre Construcciones, Instalaciones y Obras) of +- 3% of the building cost on receipt of this permit.
Based on these plans we will then make a building contract. Unlike many other contractors, we do NOT work with a fixed contract price. Nowadays the prices of materials vary enormously, and plans often evolve as the project progresses. We make the entire building process transparent, from start to finish.
